Case Study: NSW Government ICT Contract Transformation: Driving Strategic Procurement and Infrastructure Innovation

The background

We are currently advising the NSW Government on its State ICT Contract Rewrite (MICTA/ICTA), which is the most significant strategic IT procurement initiative in NSW Government procurement in the last 18 years. This new contract suite has become the mandatory framework for high-value, high-risk ICT procurement. As of 2024, we are providing ongoing advice based on this mandatory contract suite, which all lawyers and firms in NSW representing NSW Government agencies in such procurements must use.

Our services

We are currently assisting various agencies in implementing a major contract framework for significant projects.

From 2021 to March 2024, we advised and supported Transport for NSW (TfNSW) on a multi-million dollar ICT transformation project aimed at meeting ongoing and future technology needs and consolidating technology solutions across the Transport cluster. This involved several procurement activities for ICT goods and services, including service desk support, managed network services, and hosting. We were involved in developing custom contracts for these procurements and negotiating with successful tenderers.

Since 2023, we have been advising TfNSW on a statewide technology and infrastructure program, covering tender and contracting strategy, design, and documentation. Details of this work are currently confidential but can be discussed further in the future.

These matters highlight our expertise in significant ICT transformation projects, particularly for the public sector, which heavily relies on ICT products and services. They also showcase our proficiency in the emerging 'InfraTech' space and our team's capability to support clients on pioneering technology initiatives.
