2020 was a year like no other. In this webinar, we look at how administrative law responded to COVID-19.
There were challenges to public health directions and orders, which engaged administrative law principles such as jurisdictional error, apprehended bias and unreasonableness.
The Review will consider how the courts have continued to grapple with materiality, particularly unreasonableness and procedural fairness. We will examine cases which throw more light on the reasoning of decision-makers and the provision of adequate reasons for decision. In keeping with tradition, we will also explore developments in merits review and statutory interpretation.
