Overview

For over 15 years, Andrew Leece has advised Government & private sector clients on a range of major infrastructure, IT, government procurement, property, regulatory and commercial projects both in Australia and overseas.

He has a diverse client list and range of experience in the airport, energy and IT industries.

Andrew has also been involved in policy matters, attending Parliamentary Inquiries and the Productivity Commission, and drafting submissions on economic regulation, planning and infrastructure.

Notable Work
  • Andrew has advised on a number of transactions for government, including:
    • Regulatory reviews: Andrew has acted for a number of clients in relation to a number of competition and statutory notices and ACCC and ICRC queries (ICRC is the ACT equivalent of the ACCC).
    • Regulatory advice – energy, water and aviation industries: Andrew has advised on the regulatory regime with respect to pricing determinations, pricing processes, capex and opex obligations, valuation matters, planning and development, service standards and third party access requirements.
    • Department of Foreign Affairs and Trade – Expo 2005 and 2010: Andrew acted in relation to all aspects of Australia’s involvement in Expo 2005 in Aichi, Japan and Expo 2010 in Shanghai. He was involved in covering significant procurement in relation to the construction of the pavilions, IT, communications, media, support services and sponsorships.
    • Department of Industry: Andrew advised on the venture capital Innovation Investment Fund Round 1, Innovation Investment Fund Round 2, Innovation Investment Fund Round 3 and the Pre-Seed Fund programs. These funds adopted various structures including trusts, partnerships, venture capital limited partnerships, and the use of special purpose investment companies.
    • Department of Industry: Andrew advised on the establishment of a number of incentive and development programs, such as the Small Business Answers Program, Small Business Incubator Program, the Regulation Reduction Incentive Fund and the Australian Tourism Development Program.
    • Department of Human Services – Outsourcing: Telstra successfully proposed a $450 million provision of IT Managed Services to DHS. Andrew acted on the complex negotiations linking in the Commonwealth's AGTA, TLMS and Mobiles Agreements, as well the development of a new pricing and service level model – all under very tight timeframes.
    • Department of Foreign Affairs and Trade: Andrew has advised on a number of procurements including the establishment of a storage area network, the acquisition of secure satellite bandwidth, the sale and leaseback of IT hardware, the establishment of an IT contractor panel and the licensing of software.
    • Department of Foreign Affairs and Trade – Biometric Passports: Andrew advised on the development and installation of a passports appointment system and the acquisition of biometric technology for inclusion in passports.
  • Andrew has overseen the completion of various major infrastructure projects, including:
    • Canberra Airport New Terminal: In this $450 million redevelopment, Andrew acted on negotiation of agreements with airlines for the use of the new terminal. He also advised on the agreements for construction and design, security screening, IT, retail services, cabling, telecommunications infrastructure, fuel, aerobridges and baggage systems.
    • Airport development and regulation: A former General Counsel at a major Australian airport, Andrew has an in-depth knowledge of airport regulatory regimes. He frequently advises on issues including:
      • Economic regulation
      • Master Plans
      • Major Development Plans
      • Ownership restrictions
      • Airport leasing and development
    • ACTEW Corporation – Water Infrastructure Acquisitions: Acting on the potential purchase of a Thai water infrastructure provider, Andrew was required to provide detailed legal analysis around legal capacity to purchase the company, Thai regulatory matters, cross-jurisdictional issues, and carried out an extensive due diligence process.
    • ACTEW Corporation: With an estimated value of $2 billion over 20 years, ACTEW outsourced of the management and development of its water infrastructure assets. Andrew advised on the drafting and negotiation of the agreement as well as briefings to the ACTEW Board and the ACT Government.
    • Beaconsfield Grant Agreement: The Beaconsfield area sought funding to re-establish infrastructure after the mine collapse and the subsequent administration of the mine owners.  Andrew advised on the government funding agreement.
    • Private sector organisations: Andrew has advised on the receipt of Commonwealth funds for infrastructure investment, including funding for the development and extension of aprons and runways at an airport.
  • Having managed telecommunications services and having acted for both vendors and customers, Andrew has a deep understanding on the commercial and operational drivers for both.
  • Department of Human Services – Outsourcing: Telstra successfully proposed a $450 million provision of IT Managed Services to DHS.
