Overview
Stephen has extensive experience practicing in commercial litigation and restructuring and insolvency. Stephen's practice includes a diverse range of general commercial disputes, administrative law disputes, banking enforcement and recovery matters and acting for insolvency practitioners.
Notable Work
- Advising in respect of contractual and statute-based disputes, including disputes relating to joint venture projects, disputes under sale and purchase agreements, disputes with counterparties under various contracts and judicial review proceedings.
- Advised the BHP Mitsubishi Alliance from November 2003 until September 2020 in relation to a series of disputes with Cherwell Creek Coal Pty Ltd, including proceedings in the Supreme Court of Queensland and the Land Court of Queensland.
- Advised Rio Tinto in a range of litigious matters, including judicial review proceedings brought by a traditional owner group relating to the renewal of the leased area on which the Gove refinery was located in Arnhem Land.
- Advising CS Energy in respect of both litigation and insolvency issues relating to the rebuild of the Callide C Power Station in circumstances where voluntary administrators have been appointed to the other joint venture participant in the power station.
- Advised Vale Australia in proceedings instituted by Waratah Coal relating to the contested grant of an Exploration Permit for Coal in the Galilee Basin where each application for the permit had been lodged on the same day.
- Advising APLNG in its ongoing litigation with Tri-Star Petroleum in relation to its CSG fields in Queensland.
- Advised Sunwater Limited in relation to inquiries conducted by the Inspector-General of Emergency Management, contested injunction applications relating to the drawing down of bank guarantees and in a range of Right to Information requests.
- Advised Westpac Banking Corporation and various of its officers in relation to investigations commenced by ASIC (including Storm Financial Limited and the Kleenmaid Group).
- Advised lenders and insolvency practitioners in respect of a wide range of issues arising in receiverships, administrations and liquidations.
- Advises company directors in relation to the safe harbour provisions in the Corporations Act 2001 to reduce their exposure to insolvent trading claims.
