Wagih is a highly regarded expert in all aspects of planning and environmental law. He has more than a decade of experience acting and advising on the full spectrum of environment and planning law matters for both government and the private sector.
Wagih has advised on environment and planning matters for some of the largest projects in Australian history.
Wagih is specifically sought out by clients for his depth of expertise in:
- Planning approvals strategy including planning pathways, impact assessment and approvals under both NSW and Commonwealth legislation. Wagih frequently advises on major infrastructure projects and large scale greenfield and infill development.
- Land and Environment Court litigation particularly complex planning and compulsory acquisition compensation appeals, criminal prosecutions and judicial challenges. Wagih has acted for acquiring authorities and landowners in several class 3 compensation appeals, including for TfNSW in respect of one of the largest compensation claims to have been brought in NSW. Wagih also frequently acts for local councils and developers in complex class 1 planning appeals. He also acts in class 5 criminal prosecutions and class 4 enforcement and judicial review proceedings.
- Planning agreements and developer contributions Wagih has negotiated and drafted numerous planning agreements for the NSW Department of Planning and for major developers, including one for a high density residential in-fill development with contributions exceeding (AUD) $300 million in value.
- Biodiversity offsets assessment and procurement Wagih has helped devise the biodiversity offset procurement strategy for a number of large infrastructure projects. He has also acted in connection with more than half of all biodiversity credit transactions, by value, to have been conducted in NSW.

- Acting for Australian Rail Track Corporation in connection with the (AUD) $10 billion Inland Rail Programme - the largest freight rail project in Australia.
- Acting for the Commonwealth of Australia in connection with the (AUD) $5 billion Western Sydney International (Nancy-Bird Walton) Airport project - the largest airport project in Australia.
- Acting for Transport for NSW in connection with the (AUD) $2 billion M12 Motorway project.
- Advising Sydney Water Corporation in connection with the (AUD) $1.2 billion Western Sydney Aerotropolis Upper South Creek Advanced Water Recycling Centre.
- Acting for Transport for NSW in connection with the (AUD) $8.5 billion Sydney Metro Northwest project - one of the largest public transport infrastructure projects in Australia.
- Acting for the former Roads and Maritime Services in connection with the (AUD) $17 billion Westconnex project - the largest transport infrastructure project in Australia.
- Acting for the former Roads and Maritime Services in connection with the (AUD) $3 billion Northconnex project - the largest road tunnel project in Australia.
- Advising Celestino on environment and planning matters for the Sydney Science Park, a $5 billion mixed-use smart city within the Western Sydney Aerotropolis.
- Advising Dahua Group on environment and planning matters for large greenfield residential developments in western Sydney and Shellharbour exceeding 5000 lots.
- Acting for Infrastructure NSW in the (AUD) $1.5 billion redevelopment of the Sydney International Convention, Exhibition and Entertainment Precinct, Darling Harbour.
