Modern enterprise bargaining
Overview
Recent amendments to the Fair Work Act 2009 made significant changes to the enterprise bargaining framework.
To encourage bargaining, the Act reduces barriers to multi-enterprise bargaining and expands the FWC’s powers to resolve bargaining disputes, up to and including by arbitration. As a result, Employers are facing increased likelihood that they will need to bargain with employees. However, with Enterprise Bargaining having been on the decline many employers do not feel equipped to face the challenges of a robust bargaining regime and their staff may not have had recent experience in good faith bargaining negotiations. Critically, these changes mean that old strategies need to be reviewed and adapted to achieve positive outcomes and navigate legal and strategic risks along the way.
