  • Payroll compliance: We assist organisations in understanding their exposure to potential compliance issues with employee entitlements, including underpayments, leave audits, BOOT testing, and enterprise bargaining support.
  • Class action quantification: Our team collaborates with legal experts to handle large-scale data reviews, ensuring precise quantification and modelling for matters such as product liability, financial services, competition issues, multi-jurisdictional disputes, and settlement calculations.

Experience

Financial Services

A large Australian bank was facing class action proceedings, presenting a complex challenge due to the multitude of data sources with varying degrees of completeness across the relevant period that needed to be synthesised into a coherent model for resolution purposes. The proceedings required data analytics techniques to ensure accurate and complete data discovery and quantification calculations. Under instruction from the Clayton Utz legal team and in close collaboration with the client’s legal and data analytics teams, we provided end-to-end support throughout the lifecycle of the class action. Our approach involved meticulous data discovery and the synthesis of multiple data sources into a unified model, enabling robust quantification calculations. By leveraging our expertise in data analytics and legal strategy, we were able to demonstrate a data-supported legal approach, ensuring our client was well-prepared to address the class action proceedings effectively.

Aged Care, Disability and Community Services

Clayton Utz was engaged by a client in the Aged Care, Disability & Community Services industry to address the misapplication of an industrial instrument affecting a substantial portion of their workforce’s entitlements. A critical issue was the poor quality of payroll data due to extensive manual adjustments made during the payroll process. In contrast to the manual rectification process recommended by the clients previous vendor, our data analytics team implemented an innovative data correction methodology through an analytical model, handling over 615,000 shifts across 80,000 pay periods, and saving the client more than $5 million dollars in fees. In close collaboration with our Workplace Relations, Employment & Safety we built a tailored quantification model to calculate correct employee entitlements, determine remediation amounts, and support engagement with auditors and the ombudsman.

Higher Education

As a multidisciplinary team, consisting of members from both our Workplace Relations, Employment & Safety and Forensic Technology Services teams, Clayton Utz won an RFP to help a large Australian university assess underpayment risk. Collaborating with the university's subject matter experts, we crafted a bespoke quantification model designed to capture the complexities of both professional and academic staff entitlements—a unique challenge in the higher education sector. The model enabled precise underpayment calculations and helped the university fully remediate past and current employees. Furthermore, the solution allows the university to maintain compliance through ongoing payroll checks, ensuring sustained value and long-term return on investment.

Healthcare

Our client, a major Australian health care organisation, was looking for legal advice regarding patient billing. As part of a cross-functional team, and instructed by Clayton Utz lawyers, our data analytics team first worked with our client to extract and validate a comprehensive set of treatment and billing records. We then developed a data analytics model to emulate billing policies, including certain legal requirements, and reconciled that to actual billing records. The model incorporated a range of advanced modelling and statistical techniques, including sensitivity analysis and Monte Carlo methods, in order to provide our lawyers the data required to provide legal advice.
